GENERAL TERMS AND CONDITIONS OF BUSINESS
for purchasing tickets for the Kreativ Freiburg 2022


I. Scope, general
These General Terms and Conditions (hereinafter General Terms and Conditions) apply to the ordering of admission tickets on the Internet (hereinafter Online Tickets) as authorization for access to the Kreativ freiburg in Freiburg. These terms and conditions apply equally to consumers and entrepreneurs. For the purposes of these General Terms and Conditions, an entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity (Section 14 of the Civil Code).

II. Contracting Parties
The customer's contractual partner for the purchase of online tickets is drehpunkt GmbH, Breisgauer Str. 66k, 79110 Freiburg (hereinafter drehpunkt), unless otherwise stated in the product description.

III. Conclusion of contract
The offers from drehpunkt on the order pages are non-binding. By clicking on a selection field at the end of the item description on the item selection page, the items are automatically placed in the virtual shopping cart. The customer can view the contents of the compiled shopping cart at any time by clicking on the “Shopping cart” link. The products listed there can be removed individually from the shopping cart by clicking on the “Empty shopping cart” button. On a final check page, any input errors can be identified before the order is finally sent and corrected using the “Back” button at the end of the page on the previous input pages. The customer can access, print and/or save the general terms and conditions from the ticket shop.
The ordering process can be canceled at any time by closing the browser window. The customer submits his binding offer to conclude a contract by placing his ticket order online by clicking on the “Complete purchase” button.

IV. Terms of payment, offsetting and rights of retention
The total price including VAT is due for payment immediately after conclusion of the contract. Payment for online tickets is made when ordering and can be made by credit card (VISA, MasterCard, American Express), PayPal, ELV or instant bank transfer
take place. The customer has no right of offsetting or retention unless the counterclaim is undisputed or legally established. If the customer is an entrepreneur, the same applies to retention rights. If the customer is a consumer, he is also entitled to offset claims from drehpunkt GmbH if he asserts claims from the same contract. He may only exercise a right of retention if his counterclaim arises from the same contract.

V. Exclusion of the right of withdrawal and cancellation
The customer cannot revoke his declaration of intent; The right of withdrawal is excluded according to Section 312g Paragraph 2 Sentence 1 No. 9 BGB.


VI. Delivery of the online ticket (print@home)
After the contract has been concluded, the online ticket will be sent to the customer immediately in PDF format as an email attachment. The online ticket can be opened with a current PDF reader (e.g. Acrobat Reader) and printed out by the customer. The customer must ensure that the barcode printed on the online ticket is neither blurred nor damaged. In addition to the PDF, the customer receives a passbook file with the same ticket, which can be downloaded on a suitable mobile device (smartphone,
Tablet) can be saved with the appropriate software.

VII. Access to the event, customer obligations
Admission to the event is only possible with a valid ticket and within the time period printed there. The customer must present the printed online ticket at the entrance control of the respective event. Upon request, the customer must identify themselves at the entrance control with a valid official photo ID or passport. When using a reduced ticket, the identification document must be presented without being asked. Alternatively, the customer can save the online ticket as a PDF file on a suitable mobile device (smartphone, tablet, netbook) and show the display of the mobile device, on which the online ticket must be clearly visible, at the entrance control. Access to the event is only possible upon presentation of the online ticket at the entrance control. The customer must always carry their online ticket with them on the event site and show it to staff upon request. The requirements of the hygiene concept must be adhered to. If you have a respiratory illness, you are not allowed to enter the Freiburg Trade Fair grounds.

VIII. Refund if the event is canceled
If the creative freiburg event does not take place, drehpunkt GmbH will inform the customer of this immediately. At the same time, drehpunkt GmbH will refund the customer the purchase price of the ticket.

IX. Passing on the online ticket to third parties
The online tickets are personalized. The right to access trade fair events cannot be transferred to third parties. In particular, a commercial retransfer of the access authorization is not permitted.

X. Warranty
Consumers are entitled to statutory warranty rights. Compensation for damages will also only be paid within the scope of Section XI. of these General Terms and Conditions. If the customer is an entrepreneur, tickets are deemed to have been approved by the customer if incompleteness or inaccuracy in the ticket from drehpunkt GmbH is not made in text form within three working days of delivery or otherwise within three working days of discovery of the incompleteness or inaccuracy in the case of obvious incompleteness or inaccuracy is shown.


XI. Liability
In the event of intent or gross negligence on the part of drehpunkt GmbH or drehpunkt GmbH's representatives or vicarious agents, drehpunkt GmbH is liable in accordance with the statutory provisions; also in the event of culpable violation of essential contractual obligations. As long as there is no intentional or grossly negligent breach of contract, the liability for damages is the
drehpunkt GmbH is limited to the foreseeable, typically occurring damage. The liability of drehpunkt GmbH under the Product Liability Act, for guarantees and for culpable injury to life, body or health always remains unaffected. Unless expressly stated otherwise above, the liability of drehpunkt GmbH is excluded.

XII. Entry requirements, residence requirements
The offer by the organizers of Kreativ freiburg to purchase tickets via the Internet does not release the customer from the obligation to obtain timely and comprehensive information about the relevant entry regulations into the Federal Republic of Germany, in particular about the possible need for a visa. The organizers of caravan live assume no responsibility if the customer suffers disadvantages as a result of not observing the applicable entry and residence regulations.

XIII. Other provisions
drehpunkt GmbH is entitled to commission third parties to issue invoices and collect debts from the customer. The customer accepts the house rules of the operator of the relevant trade fair/conference venue. These terms and conditions apply exclusively. Differing, conflicting or supplementary terms and conditions of the customer, which drehpunkt GmbH does not expressly acknowledge in writing, do not apply. If parts of these General Terms and Conditions are or become ineffective, this will not affect the validity of the contract or the remaining General Terms and Conditions.

XIV. Choice of law, place of jurisdiction
German law applies. If the customer is a consumer and had his habitual residence in a country other than Germany at the time of ordering the online ticket, the application of mandatory consumer protection regulations in that country remains unaffected by the above choice of law. Within the meaning of Section 1 Paragraph 1 of the Commercial Code (HGB), a legal entity under public law or a special fund under public law, the courts in Freiburg have exclusive jurisdiction for all disputes arising from or in connection with the contractual relationship in question.
